Dreams Sometimes Come True

Writing about Hal Turner comes almost as second nature since I have been doing just that for years now. However, writing about Hal Turner being arrested has only been a dream of mine - until now. I only wish that the charges would come from another source - but I'll not look a gift horse in the mouth.

Several people on both sides of the ideological spectrum are asking the same question in the aftermath of yesterday's arrest - "Why now when Hal has been doing much the same thing that he is charged with for years?"

Well, I am no legal expert in these matters, but here are my thoughts - all of which are racing right at the moment.

The charges brought are state felony charges much like those brought against Bill White several months back. Unlike the White case, there have been no federal charges - yet.

In reading the news accounts and the internet post that resulted in these charges, I was struck by a couple of pronouns that Turner used - these might have done him in. Example:

Thankfully, the Founding Fathers gave us the tools necessary to resolve tyranny: The Second Amendment.

TRN advocates Catholics in Connecticut take up arms and put down this tyranny by force. To that end, THIS WEDNESDAY NIGHT ON "THE HAL TURNER SHOW" we will be releasing the home addresses of the Senator and Assemblyman who introduced Bill 1098 as well as the home address of Thomas K. Jones from the OSE.

After all, if they are so proud of what they're doing, they shouldn;t mind if everyone knows where they live.

It is our intent to foment direct action against these individuals personally. These beastly government officials should be made an example of as a warning to others in government: Obey the Constitution or die.

If any state attorney, police department or court thinks they're going to get uppity with us about this; I suspect we have enough bullets to put them down too

Using the pronouns "us" and "we" along with words like "intent," "direct action," "personally," and "put them down" pretty much implies that you and some one else intends to cause harm to your target.

Hal Turner has always been this shock-jock hate machine who vomits vitriolic threats all over the internet looking for some sort of attention. Prostituting himself for his own personal, self-serving gain has garnered him a few more than his 15 minutes of fame over the years. As others of the same persuasion have been arrested for much lesser offenses than those committed by Turner, it has been suggested that he has been more beneficial to law-enforcement running amok rather than behind bars. Considering the fact that just a couple of days ago, Turner posted a map to the Dirksen Federal Building in Chicago highlighting the location of the built in anti-truck bomb barriers while targeting three circuit court judges, it will be interesting to see if other charges are brought against this reprobate.

As expected, there are those who are decrying the arrest as a direct affront to the First Amendment. Even some who have been severely critical of Turner in the past, fear this to be an omen of future abridgements. The question that this writer would ask is, perhaps, one that would incite the protecors of that freedom even more - when the First Amendment was written, what was the intent?

Was it intended that anyone could say anything at anytime? If that was the case, then are we to assume that it is okay for another to threaten harm to you and your family? Was it intended that your right to free speech be able to interfere with my right to live, love, and raise my family without fear of intimidation or threat? I don't think the Founding Fathers intended any such thing.

There are many things happening in our country and, indeed, within the government that need our attention. We can criticize...we can protest...we can campaign...we can lobby...we can vote...we can use all sorts of peaceful means to effect change. Holding people hostage through intimidation and threats of violence is not, however, acceptable in this society - or under the Constitution.

It will be interesting to see what happens to Hal Turner. It will also be interesting to witness the reactions of those who support him regardless of the outcome.

    Good point, and there isn't any clear law other than the last ruling by the 9th district court in the "abortion Dr. hitlist case", which is the basis in which anti-racist constructed hitlist of their own, and why law enforcement never did anything about it--there was and is no law.

    It only began to become a troublesome legal wrinkle when the right-wing employed the same tactics.

    Many scholars have dedicated their whole professional careers trying to determing that, and you are going to pontificate on the WWW. how you know better than they.

    I doubt seriously that you have even read the Federalist Papers or other supplimental documentation that compliments the Constitution.

If speaking in generalities and website postings do not meet the criteria for 'imminent lawless action/likely to incite or produce such action' , 'true threat' and is obvious 'political hyperbole' then at least in HT's case, it would not be enough-unless they are trying to change law. The recurring theme in these cases seems to be looking at whether the danger is imminent* I thought the key was in specificity- but the theme of 'imminence' - proximity, degree- whether the danger is 'clear and present' - Brandenberg , Watts, Evers

  14. People have been asking this question and I'll clear it up.

    Question: How was Hal able to blog about his arrest?

    Answer: Because he knew about the warrant before he turned himself in. In misdemeanors like Hal's, the police will usually just call your house and tell you to turn yourself in. (or stop by) Hal got the call, posted the blog, and then drove down to the police station for his arrest. He probably even have time to shave and shower before going to the station.

    That's how it happened.

    More than likely, search warrants are out for anything he owns computer related.

    I am also sure that the Connecticut officials had no idea that Hal was a federal informant. There isn't a database that they can check by clicking on a name.

    Hal will claim in court he is not a flight risk, family man etc... and will get a minimal bail unless they have more than what they are telling. I think Hal is a flight risk although all the trips he posted about were faked.

    Remember with Bill White, when he got arrested, we kept saying, they've got to have more on him for such a big arrest.... and they did...

    We will see with Harold. If anything I hope this gets him sane again and starts caring about his son, wife, and mother than playing internet games involving their lives.

    As to Brandenburg - I agree that the key is imminence. However, that decision has increasingly come under fire in a modern and global society with the sophistication of communication technology as has the definition of "imminent."

    Regardless of what happens with Hal or even Bill White, I think we have reached a point in history where the courts will soon have to revisit the Brandenburg decision. I don't know if that is a good thing or a bad thing. But it is going to happen.

    Let's look at this for just a second. In a criminal court, generally the judge instructs the jury as to the law and as to what is meant by "reasonable doubt."

    Setting aside any racist or anti-government sentiments that any of us have and trying to look at the case as just average, everyday, working people would you believe that Hal Turner intended for harm to come to those he targeted.

    You can bet that the prosecution will use his past broadcasts and internet posts against him. Remember - he claimed to have an army of skinheads at his disposal and that they would do his bidding.

    Remember - he advocated Timothy McVeigh style bombings.

    Remember - he claimed responsibility for the murder of Judge Joan Lefkow's family - over and over again. He wore it as a badge of honor. He bragged about it.

    If you read the Connecticut law there is little doubt that Hal has violated it.

  33. WOW - things are moving quickly - I have been in touch with several law enforcement agencies - appears Hal troubles are just starting - I am hearing he is also going to be charge with making threats against three judges in Chicago area (maybe him and Bill will be cell mates).

    I have sent over to the folks in Conn. Hal history of making threats including the one made against me couple of years ago.

    Hopefully Hal will get many years in prison.

    Just think - was only a few monthes ago I took a break from "fighting racism" and both Bill and Hal have been arrested - guess there are other ways to skin a cat.

    After all, Hal frequently gives out encrypted communications via PGP. He has secretly left the US for the UK without going through the official channels.

    He contacted me asking for the audio clip of the threat Hal Turner broadcasted against me in the summer of 2007, they want it to us it , to show this is a pattern with Hal Turner threatening people.

    I gladly sent them the 3 minute mp3 so they could hear in Hal's own voice that "I was to be beaten up and sent to the hospt." when I was in New Jersey giving a anti racist message.

    There is a good possibly I will be called to give testimony in Hal's trial.

If you read the First Amendment to the United States Constitution literally it of course expressly prohibits the United States Congress or states from making laws "infringe the freedom of speech" However in practice there are many laws passed by both congress and the states that do in fact limit freedom of speech: There are many laws sending people to jail for speech. Threatening people, yelling fire in a movie theatre, and lying under oath to name just a few.

    The Connecticut law that Hal has clearly violated and been held up in federal court no less than 33 times, twice going as far as the Supreme Court of the United States (neither time did they rule but deferred to the opinions of the lower courts). Clearly Hal was not protected under the First Amendment when he threatened the lives of others, including elected officials. Don't be surprised if Hal doesn't pick up federal charges for threatening federal judges.

    Leftist’s philosophy and economics do not go hand and hand. Saying the word liberal and economics in the same sentence is quite comical and the liberal media is not a wise selection for your economic truths.

    Now lets get to the real root cause of the economic meltdown, which is the increase in the cost of a barrel of oil. You say, how could oil have anything to do with the banking crisis or the mortgage meltdown or the automotive industry collapse, etc. Stop, don’t leave me here. Lets look at this from a standpoint of reason and logic, which is missing in the leftist distorted form of economics.

    There are certain things that man today cannot go without. They include water, food, gasoline, shelter, and energy in that order. If you break a person down to a dire financial situation the number one priority is water and food for survival. Man will inherently do what it takes to survive and if all options are exhausted he will pick water and food over shelter, gasoline and standard energy.

    So you may say why does gasoline come before shelter. One must get to work to buy the food that is needed for survival. Worst-case scenario a person could live in a tent or in their car. Sure the pride is smacked around a little in this situation but coworkers don’t necessarily need to know your living situation. Imagine the punch to your pride from showing up to work on a bus in a small city where mass transit is not a standard way of transportation as it is in NYC. Or spending an extra couple of hours each day waiting around for the bus and modifying your work schedule based on the bus schedule.

    How about those who do not have bus transportation to work? We live in a society today that most people could not easily walk or ride a bike to work.

    Now lets get back to the rising costs of gasoline and it’s effects on the US sub-prime housing market. The decision of the Organization of Petroleum Exporting Countries (OPEC) was to increase the cost of oil similar to what they did during the Oil Embargo of 1973-74. Oil is used in everything from planes, cars, tanks, fertilizer, drugs, plastics, etc, etc, etc. It is also used in the method of transportation to get food and all other products to stores. Increase the price of oil and you increase the costs of all goods.

    Currently OPEC consists of Algeria, Indonesia, Iran, Kuwait, Libya, Nigeria, Qatar, Saudi Arabia, United Arab Emirates and Venezuela. Basically a bunch of countries that have faired pretty well through this economic crisis until just recently when oil prices started to fall. This is why OPEC got back together a couple of weeks ago to decide if they are ready for another cash pump into their economies. Other non OPEC producers are countries like Mexico, Norway and Russia which often go by OPEC’s position of the day.

    A little history. In 1973 on the Jewish holy day of Yom Kippur, Israel was surrounded. Egypt attacked from one side at the same time Syrians surprise attacked from the other. With help of the western states, Israli troops quickly outflanked them all and later a cease-fire was established. But on October 17th, OPEC struck back by imposing an Oil Embargo on the US and all other westerners that supported Israel.

    The exact same thing has happened today with our war that the Muslims feel is a war on Islam.

    Here’s the answer to “the speculators created the crisis” statement. You are probably thinking, how did Wall Street respond during the embargo? The exact same way they responded today. Speculators (investors) bought oil contributing to the crisis but they did not create the crisis. Just as the banks gave risky loans that contributed to the crisis but did not create the crisis. The 1973-74 Oil Embargo ended up being the middle of the great bear market that would see the Dow go from it’s high of 1051 in 1973 to 577 by the end of 1974 or a whopping 45% decline in almost 2 years! That’s right, the economy collapsed due to the Oil Embargo.

    The federal government is fully aware of this. They are not stupid. They have intentionally created “stories” based on what seems to be “logical” reasons for the crisis via their “economic experts”. They feed these “stories” to the nonfunctional mass media that parrot these “stories” for the crisis as a means to not tell the world and the Middle East that the oil producing countries in all actuality are in complete control of our economy. Would you tell OPEC that they have you by the family jewels and there is nothing that you can do about it?

    The banks for the most part lent money to people who could afford to repay their debt. But they could BARELY repay it. They were risky to lend to. They were paycheck to paycheck after a loan. But they had been determined to be able to pay the debt. Just not to have anything left over.

    Now add the radical jump in the cost of gasoline and an additional $300 in costs of gas per month to someone who is paycheck to paycheck. Now add the increase in the costs of goods and food adding another $200 dollars to their monthly budget and what does the scenario look like. So what comes first for survival? Food or mortgage? Gas or Mortgage? Gas or Food? Human instincts made the logical decision. You have to eat and that is a number one priority. And you have to get to work so you will be able to eat.

    Those who were not sub-prime were not affected to the same degree, as there was a margin of error built in. But as crisis continues it’s ripple effect spreads throughout all income levels, businesses and the rest of the world. But the United States crisis was not entirely the direct result of other countries economic crisis. Oil was. The domino effect. The increase of the cost of gas and everything else related to it, knocked the legs right out from the world economy.

    Now we have the automotive industry crash. The auto industry works within some very tight constraints when it comes to their return on investment. Contributing factors include poor investment decisions by the executives and the crushing force of the unions.

    How could a company survive when they have to pay their workers 123% more in wages than the average manufacturing worker? Compare their salary to state college professors. What exactly is so special about assembly line work? Most of them have nothing more than a high school degree.

    $75 is the average cost per hour of an autoworker. That is based on a 40 hour work week - with overtime this figure gets even more ridiculous.

    $1,500 to $2,000 of every car goes to pay the health care costs and benefits of UAW employees.

    GM pays $17 Million dollars a year for Viagra

    Quite simply put, how can a guy who makes $15 dollars an hour pay for a car that is made by a guy who makes $75 dollars an hour? Especially when he was paycheck to paycheck prior to the economic meltdown which created a dire eat or pay your mortgage situation for him.

    So the question now is, how exactly has Bush’s multi billion and Obama’s multi trillion dollar bailouts helped eliminate our dependence on foreign oil? How much went to useless social programs? How much paid for the Band-aids to cover the wound but not actually fix it? I would be willing to bet that almost all of it did. And, If we spent every penny of the trillions taken from the American tax payer on developing energy solutions would we have been able to completely eliminate our dependence on oil imports?

    Turner Released from Jail!

    Jersey City & Kearny, NJ (TRN Staff) -- At a 3:30 PM hearing held yesterday in the Superior Court of New Jersey at 595 Newark Avenue, Jersey City, the Honorable Judge Kevin Callahan ordered that Hal Turner be freed on bail. At about 2:30 AM Tuesday morning, Turner was released from jail after posting $25,000 bail.

    Turner had been held without bail at the Hudson County Correctional Center in Kearny, NJ after the State of Connecticut filed criminal charges against him over an opinion Turner expressed on this blog.

    The opinion was uttered in New Jersey. At no time relevant to the criminal charge was Turner in Connecticut and no time did he contact any individual person in Connecticut. The unedited, original opinion which generated the arrest was titled "State Restricts Catholics from Politics" and remains available to the public lower on this page

  125. I said he'd be out in 48 hours so I was off by a few days. Hal is very buddy-buddy with the feds and I knew he wouldn't spend long in the can. Its highly doubtful that he'll see the inside of a prison cell for a very long time, if ever. Now is a good time to compare the Bill White case and the Turner case.
