Lawyer blames school in shooting of gay Oxnard student
Attorney for youth facing arraignment on murder charges says officials failed to defuse tensions.

As 14-year-old Brandon McInerney prepares to be arraigned today in the slaying of 15-year-old Lawrence "Larry" King at E.O. Green Junior High School in Oxnard, his lawyer is advancing a defense that at least partly blames school officials for the tragedy.

Educators should have moved aggressively to quell rising tensions between the two boys, which began when King openly flirted with McInerney, said Deputy Public Defender William Quest.

Instead, administrators were so intent on nurturing King as he explored his sexuality, allowing him to come to school wearing feminine makeup and accessories, that they downplayed the turmoil that his behavior was causing on campus, Quest said.

On Feb. 12, McInerney shot King in the back of the head with a handgun as first-period classes were beginning, according to police. McInerney's inability to see another way to solve his problem is partly the fault of the school system, his attorney said.

"Brandon is not some crazed lunatic," Quest said. "This was a confluence of tragic events that could have been stopped. If there is partial blame in other places, let's not throw away Brandon for the rest of his life."

McInerney has been held in Juvenile Hall in lieu of $700,000 bail since the shooting. Ventura County prosecutors have announced their intent to try him as an adult. The teenager is scheduled to enter a plea at today's proceedings, but Quest said the arraignment may be postponed until the court decides on his motion to try him as a juvenile.

Under state law, juvenile offenders can be incarcerated until the age of 25 and then must be released. If he is convicted as an adult, McInerney would face 50 years to life, with an additional three years for a special hate-crime allegation.

"We think there will be evidence that the school, with the actions of Larry, didn't quite know how to deal with it," Quest said.

School Supt. Jerry Dannenberg strongly disagreed with such allegations. "School officials definitely were aware of what was going on, and they were dealing with it appropriately," Dannenberg said Wednesday. King was constitutionally entitled to wear makeup, earrings and high-heeled boots under long-established case law, Dannenberg said.

Totten said he was open to further discussion on trying McInerney as an adult. Prosecutors are looking at all of the evidence and are considering pleas from the community, as well as from McInerney's family and friends, he said.

  2. I think it is tragic. Both young men have had their futures taken away from them.

    One was murderd by his classmate.

    The other one will spend many years in prison for this crime.

    Our schools are many times not places of learning, but have become places where crimes are committed and when students go to the office for help receive no help period. That is not new and has been going on for years. Yes, maybe the schools do have to start giving an account of all the times they have failed their students by allowing crimes to be committed against them and refusing to help in anyway and just continue to let students be victims of crime in schools by their fellow classmates.

Something is very wrong with you Steve if you think that it is okay to murder someone that "you don't know how to deal with" but then you think it's okay to teach your children to pick up underaged girls on the internet and to write hot checks, eh Steve? Gee I think I read somewhere in the Bible that stealing is wrong.

  6. Chris58 - it is one of the most tragic stories, I agree. One dead and another's life ruined.

    I have read some of the testimonials about the young man who was killed. Many of his friends loved him. By all accounts, he was witty, bright, and a lot of fun to be with. Consequently, it seems as if, at least some students, had no problem with him.

    According to the defense attorney, the victim harrassed the shooter by "flirting" with him. He also claims that the school should not have allowed the victim to wear feminine things as it was "disruptive."

    Now...most school districts have very strict policies on sexual harrassment - but, those policies are only as good as the people who enforce them.

    The gay community has come forth with a petition asking the courts NOT to try this young man as an adult.

    I have mixed feelings about the case. Wrapping my mind around a young teen bringing a gun to school, walking into a classroom and shooting another at point blank range because he was "flirted" with is just beyond my comprehension.

    Where did he get the gun? Why did he feel justified in taking another's life? Did school officials take any action to stop the harrassment - if so what did they do?

    Being gay is not a crime and we live in a world filled with people of differences. Children must learn to accept others for who they are - and above all, that we don't kill each other because of differences.

    Will trying this child as an adult solve anything? Probably not.

    Nikki - Brandon McInerney must be tried as an adult. If you were Lawrence King's father, could you bear the thought of McInerney walking out of prison at the age of 25 after deliberately and premeditatedly taking the life of your son? I think not. We must send a message to these punks who think they can just cap someone simply because they don't like them - if you do it, your own life is, for all intents and purposes, OVER with.

    However, the school also bears responsibility - for allowing Lawrence King to dress up like a girl. You don't go to school to "explore your sexuality"; you go to school to GET AN EDUCATION. Childhood is supposed to be an apprenticeship to adulthood, not a 17-year-long party. Like it or not, there are only two genders, male and female, and your genitalia defines your gender. This is why all schools should require uniforms.

  9. Alaska - great points on both counts. Somehow we definitely do need to get the attention of these kids who think they can kill others simply because...

    In today's world, most 14 year-old kids know and understand the finality of death. When this kid picked up the gun he KNEW what he was going to do.

    However, I would still like to know where he got the gun and what role the parents play in all of this. As I said, trying him as an adult probably won't "solve" anything - but, based on the points you just made, it might be a start to sending a message to others that such things won't be tolerated.

    As to school dress and uniforms...

    Several years ago, I worked with a 15-year old transexual. When she entered my office, by all outward appearances she was a very slightly built male.

    She was having all sorts of problems in school as she refused to be recognized as a female, refused to dress as a girl, and refused to use the appropriate bathroom facilities. Had the school required uniforms some of the problem might have been solved.

    School officials had absolutely no idea how to deal with the situation. Even though the student was well-liked by many, she was said to be a disruption to the learning process.

    If the victim in this case WAS harrassing the shooter, the school should have applied the same consequences as would be used between a male and a female - and they may have. There is simply not enough information yet.

    But, by anyone's logic - McInerney had no justification for murder.

    Who do you think it was who provided the information to put Tom Winnicki in prison with the evidence???? It was hard evidence turned over by VNN to the CRMP (Royal Mounted Police = Canadian FBI).

    And how does Alex Linder get the $300 a month he pays to run VNN although he's living off social security himself in a section 8 apartment on S Washington in Kirksville?

    The real problem racist groups are with groups like the Aryan Brotherhood or those who never use the web. Much harder to track and much more dangerous.

    Burks is salvageable as a human being. I think Drake is too paranoid, Blevins is mentally ill, and Bill White is laughing his ass off. So am I.

  22. Especially with women but it also happens a lot with men, a person will attempt suicide several times before actually doing it.

    Men tend to be more violent with their suicides, women tend to do things like overdose on pills. Now we know Blevins is a beta-male easily dominated but he did attempt to shoot himself years ago.
